6:13 am
asked if his personal trainer had given him anything to inject himself with. the former giants slugger was trying to mislead the grand jury with the rambling answer so they convicted him on the obstruction charge. bonds lawyers will argue that his answer may have been unresponsive but it was truthful. even though he told the truth his answer was still immaterial to the grand jury investigation. it didn't have bearing on the findings. legal analysts tell the associated press it's hard to get a verdict over turned in federal court. in this situation there is a lot of respect for a judge who oversaw bonds's perjury trial. one reason the judge hardly ever has her cases over turned. reporting live in san francisco, bob riddell, "today in the bay." >> thank you very much, bob. in the meantime, bonds former team is starting its quest for another world series championship. >> a fun time of year.

burst into flames. we have a reporter on the ground in san bernardino county this morning gathering new information about this. we'll have a live report coming up in a few minutes. >> now to president obama and the state of the union address. today the president is leaving the white house traveling to three different states to push one of the key points from the speech last night. create more manufacturing jobs and trying to jump start the economy. marla joins us in studio with an expert opinion on where the president has to go from here. >> good morning. that expert opinion coming from santa clara university. thanks for joining us. the president opened saying the state of the union is stronger. he started talking about jobs, of course. you say much of the speech came back to the same thing. republicans say it lacked substance. >> i think broadly he was trying to ingrate a theme of so many things are related to the economy. whether it's education,
6:31 am
immigration, energy, these things will fuel our economy if e we improve energy independence. i think it was synthesizing themes he touched on earlier. there wasn't a lot of new initiatives but it was hitting things he believes are important. >> he also talked about ending the war in afghanistan and said that will happen the end of 2014. is there anything he didn't talk about that he should have? >> there are a few things. i thought he might talk about some of his nomineeses that he's trying to get confirmed in the senate. the fact that chuck hagel, there is debate about whether or not he should be confirmed. often times presidents will call for a fair up or down vote on the nominees. since he struck the theme later on with gun control, that deserves an up or down vote. it may have been he wanted to avoid it. there was nothing controversial, nothing new. so i think he was trying to play it safe.
6:32 am
it was a pragmatic speech. >> you mentioned gun control. let's look at the moment of the night when he talked about gun control. >> gabrielle giffords deserves a vote. the families of newtown deserve a vote. >> do you think that will help? >> he was not saying you have to approve this or you have to vote yes. he was saying let's have a vote. go on the record. say, no, i'm not in favor of this. basically saying the american people deserve a vote on this. you need to go on the record where you stand on this bill. >> what would you grade him as a professor? >> maybe a b minus. it was above average.
6:33 am
earlier first term addresses. it was interesting that it was charles darwin's birthday yesterday. he didn't bring up science as much as i thought. he could have talked about science, education. i would say a b minus. >> still above average. thanks so much. >> we love the weather. you would give this an a plus, right? >> i would. i don't know. some people like the fog and the cold. you can't please all of the people all the time. we're pleasing the warm weather people today. taking a live look at daily city. we talk about patchy fog. this is what we mean. it's not one thick dense blanket located over daily city. you can see through it and this ml will spin out very quickly as we head throughout the day today. your temperatures are chilly to start. good morning in gilroy. 36 for livermore. 37 degrees to start the day in sunny vail headed for a comfortable afternoon. your forecast tells the story. at noon in the big to upper 50s.

6:40 am
6:41 am
6:42 am
breaking news at 6:43. new details about a police officer shot overnight in the east bay. police in pittsburgh are searching two locations for clues on both ends of 11th street. kristy smith is live with what we have learned just moments ago. kristy? >> good morning. that officer was shot but the good news is he's already been treated and released from the hospital. right now several streets are shut down near 11th and maple as investigators look for more evidence this morning in the shootout that sent two people to the hospital. the officer and a suspect with a long criminal history. the 30-year-old man had warrants for violence and dpun related charges. that man bolted, took off running as officers chased him. they say he turned and started
6:43 am
shooting. one officer was hit. even though he was wounded he and his partner fired back, hitting the man. a violent and potentially deadly night. >> our officers did a tremendous job. they come to work knowing they can face a situation like this. they acted upon the threat and did what they are trained to do. we're glad they are both okay. >> reporter: the suspect was hospitalized but is expected to survive. police are questioning a number of witnesses and other people who were at the scene at the time. the officer's shot is a five and a half year veteran of the police department. pittsburgh police are expected to release more information about the officer as well as what the oakley man was doing here in the first place. reporting live in pittsburgh, kristy smith, "today in the bay." >> we are following overnight developments in the man hunt for former l.a. a police officer christopher dorner. the cabin where he was reportedly holed up is now nothing but rubble after a
6:44 am
police stand off turned into a firefight there. tony schinn is live with the developing story. right now we are hearing that dorner's i.d. and official report says they found it in a wallet burned down inside the cabin, correct? >> reporter: good morning, john. that's right. we are attributing this to the associated press. they are the ones who were reporting that his burned driver's license, his i.d. was found at that cabin. perhaps inside the cabin. it gives you further proof, that it is confirmed that the man who was inside the cabin, you know, is christopher dorner. you know, they found charred remains inside there. i can tell you they are not officially confirming the law enforcement here at the crime scene. that is christopher dorner. i can tell you law enforcement officers have been milling about
6:45 am
and they are all breathing a sigh of relief. they are lax out here. just letting investigatorses come in, search for clues. as far as they are concerned, that's christopher dorner. so the dna testing to determine exactly who those charred remains belong to sounds like it's just a formality at this time and a driver's license only really adds more credence to the belief that christopher dorner is dead and this man hunt is over. >> all right. thank you very much for the report. we'll continue to follow this as information comes in. >> we do know a riverside officer investigators say dorner am a bushed last week will be laid to rest this morning. governor jerry brown and thousands of others will attend the funeral for michael crane at a church in riverside. we'll bring you continuing coverage throughout the morning and all day on nbcbayarea.com. just head to our home page or search using the key word
